Probable cause affidavit: SUBMITTED BY: LAUGHLIN, JEREMY 0617 (AR09110395) DID BEING IN A COUNTY PARK AFTER DESIGNATED HOURS, VIOLATE COUNTY ORDINANCE 74-41 ON 080809 AT APPROXIMATELY 2315 HOURS, I WAS CONDUCTING A SECURITY CHECK OF THE HERNANDO BEACH PARK, WHEN I OBSERVED A SUBJECT/DEFENDANT SLEEPING UNDERNEATH the PAVILION. I ADVISED DISPATCH OF the SUSPICIOUS PERSON AND GOT OUT TO MAKE CONTACT with THE DEFENDANT. DEPUTY SCHAFFER THEN MADE CONTACT with ME VIA TELEPHONE, AND ADVISED THAT HE WAS OUT WITH A SUBJECT APPROXIMATELY 20 TO 25 MINUTES PRIOR, BUT HAD TO LEAVE ABRUPTLY DUE TO A PRIORITY CALL. HE ADVISED that HE HAD THE ID CARD OF THE PERSON HE HAD ORIGINALLY MADE CONTACT with. I ATTEMPTED TO MAKE CONTACT with the DEFENDANT WHO WAS SLEEPING UNDERNEATH the PAVILION; HOWEVER, AFTER SEVERAL MINUTES OF ATTEMPTING TO WAKE THE DEFENDANT HE CONTINUED TO SLEEP. WHILE ATTEMPTING TO WAKE THE DEFENDANT, I OBSERVED A WALLET AND CIGARETTES DIRECTLY TO THE RIGHT OF THE DEFENDANT, AND DIRECTLY NEXT TO THE DEFENDANT'S HAND WAS AN OPENED CONTAINER OF A 16 OUNCE, "STEEL RESERVE" ALCOHOLIC BEVERAGE. THE ALCOHOLIC BEVERAGE WAS APPROXIMATELY HALF EMPTY AND STILL HAD CONDENSATION ON the CAN. I AGAIN ATTEMPTED TO WAKE THE DEFENDANT, AND FINALLY the DEFENDANT AWOKE. UPON SPEAKING WITH THE DEFENDANT, HE ASKED FOR HIS ID CARD BACK; HOWEVER, I ADVISED HIM that I DID NOT HAVE HIS ID CARD. THE DEFENDANT IDENTIFIED HIMSELF AS MR BENJAMON PYNES. WHILE SPEAKING WITH THE DEFENDANT, I COULD DETECT A STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS PERSON, and ALSO OBSERVED SEVERAL OTHER CANS OF STEELE RESERVE ALCOHOLIC BEVERAGES TO BE NEXT TO the DEFENDANT. DEPUTY SCHAFFER THEN ARRIVED ON SCENE, AND PROVIDED ME WITH AN ID CARD; THAT OF BEING THE DEFENDANT'S. DEPUTY SCHAFFER ADVISED HE HAD PREVIOUSLY SEEN THE DEFENDANT UNDERNEATH the PAVILION AT THE PARK AT APPROXIMATELY 2250 HOURS, AND THE DEFENDANT WAS CONSUMING the ALCOHOLIC BEVERAGE. DEPUTY SCHAFFER STATED THAT HE ADVISED THE DEFENDANT TO THROW AWAY the ALCOHOLIC BEVERAGE. HOWEVER, AT THAT TIME, DEPUTY SCHAFFER HAD TO LEAVE ABRUPTLY DUE TO the PRIORITY CALL. the DEFENDANT WAS THEN ADVISED THAT IT WAS AGAINST COUNTY ORDINANCE TO CONSUME AN ALCOHOLIC BEVERAGE IN the COUNTY PARK OR RECREATION AREA, AND THAT IT WAS AGAINST COUNTY ORDINANCE TO BE IN A COUNTY PARK/RECREATION AREA AFTER HOURS. THE DEFENDANT BECAME IRATE, AND STATED that WE WERE HARASSING HIM, AND THAT HE WAS NOT HURTING ANYTHING. THE DEFENDANT WAS PLACED UNDER ARREST FOR BEING IN A COUNTY PARK AFTER HOURS AND CONSUMPTION OF AN ALCOHOLIC BEVERAGE IN A COUNTY PARK. THE REMAINDER OF THE ALCOHOLIC BEVERAGES WERE DUMPED OUT AND THROWN INTO THE TRASH. the DEFENDANT ADVISED THAT HE HAD NO OTHER BELONGINGS AT THE PARK; HOWEVER, THERE WERE NUMEROUS CLOTHING ITEMS and GARBAGE AROUND the IMMEDIATE AREA WHERE the DEFENDANT WAS SLEEPING. the DEFENDANT WAS HANDCUFFED (DOUBLE-LOCKED), AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. HE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. the DEFENDANT'S BOND WAS SET AT $250.00, PER THE BOND SCHEDULE. *NOT-EXEMPT*
